What Is a Partnership Tax Return?

Understanding IRS Form 1065
Form 1065 is the U.S. Return of Partnership Income, used to report a partnership’s financial activity to the IRS. While the partnership itself doesn’t pay tax, it must file Form 1065 and issue Schedule K-1s to its partners.
Understanding New York State IT-204
IT-204 is the New York State equivalent of Form 1065. If your partnership does business or earns income in New York, you must file this form in addition to the federal return.
When Are These Returns Due?

Who Must File a Partnership Return?

General and Limited Partnerships
Any partnership with more than one member must file Form 1065 and may require an IT-204 in New York.
Multi-Member LLCs
By default, multi-member LLCs are treated as partnerships for tax purposes and must file a partnership return unless they elect corporate taxation.
New York Partnerships
Partnerships operating or generating income in New York must file IT-204 regardless of where they are based.
